General LiabilityWaiver
By registering for and participating in any digital or in person classes, courses, or programs offered by byMarnie ("the Company"), I acknowledge and agree to the following terms:
Voluntary Participation
I voluntarily choose to participate in online movement, breathwork, meditation, and energy-based classes offered by By Marnie. I understand that these activities may involve physical exertion and carry certain inherent risks, including but not limited to injury, aggravation of pre-existing conditions, or emotional discomfort.
Health and Medical Disclaimer
I certify that I am physically and mentally able to participate in the classes. I understand it is my responsibility to consult with a physician before beginning any exercise, breathwork, or energy practice. By participating, I affirm that I have no medical conditions that would prevent my safe involvement.
Assumption of Risk
I knowingly and freely assume all risks, both known and unknown, associated with participation in By Marnie’s online offerings, including any injury, illness, or other damages that may arise, whether caused by negligence or otherwise.
Release of Liability
I hereby release, waive, and discharge By Marnie, its owner (Marlena Baylinson), instructors, contractors, affiliates, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to my participation in the online classes, including, without limitation, any claims for personal injury, property damage, or wrongful death.
Personal Responsibility
I understand that I am responsible for listening to my body, modifying movements as needed, and stopping any activity that causes discomfort or pain. I agree to practice within my own limits and capabilities.
Technology and Privacy
I understand that online classes may be conducted via third-party platforms (e.g., Zoom). I am responsible for ensuring my own safe practice space and stable internet connection. By participating, I acknowledge the inherent privacy and security risks associated with online platforms.
Media Release
I grant permission for By Marnie to use any class recordings or screenshots that may include my likeness for promotional or educational purposes.
Governing Law
This agreement shall be governed by the laws of New Jersey, and any legal disputes shall be handled within the jurisdiction of New Jersey.
